  • My brand new car!

    Is not so new anymore...

I was driving home from work today on the Cross Island Parkway and there was an accident on the other side of the road. Naturally, everyone was rubber necking, so I was stopped in traffic. So some guy who wasn't paying attention offset rear ended me and then proceeded to side swipe my 3 month old car - a 2005 Scion tC.

Guess I won't be waxing my car anytime soon, huh?

    Oh what a crime...

I feel so bad for you...

We've been so lucky so far, (Knock on wood), that we haven't been hit since moving to California. Traffic here is absolutely crazy.

Hopefully insurance will come through and help put your brand new car back on the road again...

Be sure to file for diminished value since it's a brand new vehicle. When my dad's 2 week old Audi was hit in a PARKING LOT, not only did we get all repair costs covered by the other guy's insurance, we got a $4000 check for diminished value seeing as how it was a brand new car.

Wow! Thanks for adding this George, I didn't know this was possible... (I haven't been in a wreck in a while)

That is a bummer man! I feel for you.... My s10 I use to have was 5 months old W/7500 miles and someone pulled out in front of me and that was all she wrote! $6000 later it was "like new" or was it..... had some dealer troubles after it had been "fixed" improperly, so I wrote a email to the owner of the dealership where the truck was "fixed". The next morning I got a phone call to bring the truck back in and they went in to overdrive and fixed everything and then some.

Sorry to hear that. My parents have a new Buick LeSabre and it was hit in a parking lot last month. The other guy just drove off!! My parents were in the store. Hit and run!! Did several $ damage.

Last March my wife and I hit a dog doing 60 MPH, both airbags deployed and did anumber on the front end. I was sick! The main thing though is to remember no one got hurt! Car can be fixed.

Well yea, the most important thing is that I didn't get hurt. In fact, the way the guy hit me, I felt practically nothing becauce he grazed the bumper and only tore off the bumber cover...then side swiped me.

Well, I feel ok now, my neck is a little stiff - guess we'll see what happens in the morning.

Yeah, I left that out!! It was a long day at work. I'm a dog lover and I felt bad. My nickname is now dogkiller at work!! All I remember is "Oh dog" then WHAM!! It was not pretty. I won't go into details. Dog, well he's in doggie heaven.
BTW airbag deployment is something we do not want to experience again!!

Sorry to hear about your misfortune,
hopefully they will just total it out and pay you off, remember you dont have to settle for book value If it costs more to replace the car with an identical one (same options, same mileage).

Also as far as diminished value, only a few states mandate insurance companies pay diminished value,

Diminished value is based on the idea that any car that has been in an accident, regardless of how well the repairs are done, is worth less than the exact same car that hasn't been in an accident.

What you can do: In 14 states, it's allowable for you to file a claim for that lost value. Thirty-six states and Washington, D.C., do allow insurance companies to exclude payments for diminished value, so if you live in one of those states, you won't get to claim the loss. But in Florida, Georgia, Hawaii, Kansas, Louisiana, Maine, Maryland, Massachusetts, North Carolina, South Dakota, Texas, Virginia, Washington and West Virginia, you have a chance of getting a diminished value payment. Successful cases are also generally made against the at-fault driver's insurance by a third party

FromThisSoil, sorry to hear!!! I bought my truck brande new in 2002, I had it for 4 weeks when one mourning I woke up and some moron had sideswipped my truck from gas door to just before front fender. I suspect drunk or falling asleep driver. I drove around for hours looking for either a bronco, bronco II, F-150, F-100, Gen 1 Ranger, with a missing passenger side view mirror because I found it on the floor! Anyone that knows that mirror also knows how unmistakeable it is!!! Good luck FromThisSoil, and if you get bored not having your car to wax, come over and we can wax mine!
